One of the main changes to the ASTs is that they will automatically become Contractually Periodic (as
opposed to Statutorily Periodic) after 6 months. There are FIVE reasons for this, including why the
High Court recently held that a Section 13 notice overrides a contractual rent increase.
The C.A.R.L. system does a fantastic job in printing a document to screen with the required
embedded data. However, the responsibility to ensure that the agreement fits the circumstances
appropriately for each and every occasion lies with the agent.
Where agents print and sign the document without checking it thoroughly, complications
can, and do, occur and the landlord and agent may find themselves on the wrong side of a legal
challenge.
One of many examples of areas that are often overlooked is: does the agreement you are about to
issue fully fit the requirements of a non-managed tenancy? It’s not only the deposit provisions
you need to consider when issuing a ‘tenant-find’ agreement.
